Role of the Copyright Associate
Within the LRS is a copyright specialist who assists
all Bow Valley College faculty and staff to comply
with Canada’s copyright legislation and to adhere to
the terms of the college’s licence with
AccessCopyright and agreements with other
organizations. This reduces the risk of lawsuits
against the institution for infringing the economic or
moral rights of authors, other creators, and
publishers.
The Copyright Associate can act on your behalf and
help you obtain clearance to use copyrighted materials
as class handouts or reserve readings, to incorporate
in paper-based course guides or in online courses, or
to sell in the bookstore. Note that the fair dealing
concept of copyright law only applies to private
study, research, criticism and review, not to general
instructional use within the college.
The preferred method of submitting requests to the
Associate is to complete and e-mail the copyright
release request” form found in Outlook’s Public
Folders at
02.Forms and Guides\Copyright. The more
information you can provide about the intended
audience and use of the material, the quicker the
response time will be.
Copyright and Digital Materials
Please be aware that permission to use materials in
hardcopy format, does not extend to digital
use. Prior permission is required to copy both text
and graphics from or into any digital medium,
including the Internet and WebCT. College policy
dictates that before linking to an outside website
that a request be made to the site owner, advising
them of the planned link(s), unless the terms of use
displayed on the web site specifically permit linking.
Copyright clearance is also mandatory for the
duplication or transfer of sound recordings, films,
videos and CDs.
Although ideas or facts cannot be copyrighted,
adapting, modifying or adding to someone else’s
creation requires permission from the copyright
holder. In the case of third party material found on a
web site, you will need to seek permission directly
from the creator or copyright holder.

If you wish to show a rental video or DVD of a feature
film in class, first check with the Copyright
Associate to see if it is covered by the college’s
public performance licence with Criterion Pictures. To
search their database of videos or for answers to
questions about public performance rights, please see

Other Services
The Copyright Associate is available for consultation
and providing information sessions for staff, as well
as conducting research to determine who owns the
copyright for specific material or if it falls into
the public domain. An approved Resource

Advice can also be provided on protecting documents or
works you have created. If you are selling curriculum
or programs to outside organizations, or requests are
made to adapt your materials, we can assist you in
preparing a licence.
